IBE MARINA SLIP POLICY

The Board wants to remind everyone that the marina is for the sole use of IBE residents as per the following policy guidelines.

  1. Marina slips may only be licensed by or sub-let to IBE residents who either have a boat or will have a boat during the licensed year. Anyone subletting their spot to an outside resident will lose their marina slip.
  2. IBE residents wishing to license a marina slip, should contact the Resident Manager to have their name placed on the waiting list. Allocation of these slips will be based on the order in which they were placed.
  3. An IBE resident may license an additional marina slip so long as there is no resident on the waiting list, and will have to relinquish the additional slip once there is a waiting list.
  4. Slip holders are entitled to occupy the same slip they occupied the previous year.

  7. Except as allowed below, the marina slips are not transferable.
    1. a slip holder may sub-let their slip on a temporary basis to another IBE resident on terms acceptable to them with consent of the Board;
    2. slip holders may agree to exchange their slips upon notice to the Manager. A slip holder who has notified the Manager that they wish to change their slip to a slip that is turned back for re-allocation, shall have priority over the residents on the waiting list;
    3. a slip holder who sells his/her residence at IBE must turn the slip back to IBE for re-allocation based on the waiting list, the only exception being if the sale is to his/her spouse, whether through marriage or common law, children and grand children of any of them.
    4. If there are no residents on the waiting list, then the selling resident may transfer the slip to the buyer of his/her residence or turn the slip back to the Manager for no payment if the buyer does not wish to acquire the slip.
  8. Invoices for slips will be sent out each year to current slip holders (Remove: with the Annual General Meeting information package). The slip holder has the right to elect to continue to license the slip by payment in full of the marina license fee for the current year. Payment in full of the marina license fee must be received by IBEMC by midnight, May 15 of each year (valid until May 15 of the following year) failing which the slip will be re-allocated to a resident next on the waiting list.
  9. Marina slips for small craft on the north side of the most northerly dock will be unassigned and for day use only.
  10. No boats are to be tied to any portion of the marina docks that are not designated marina slips. No structure is to be attached to the marina docks or erected close to the marina or its docks without the consent of the Board.
  11. No boats, kayaks, paddle boards, etc are to be pulled up and left on the grassy marina shore.
  12. By making payment of the Marina Slip Fee the user acknowledges and agrees that IBEMC is not responsible in any way for anything that happens to your boat, motor or contents, be it collision, sinking, theft, vandalism, rodents, fire, or any partial or total damage or loss however caused, and that use of the IBE marina is wholly at the user’s own personal and property risk and as such will maintain adequate insurance as the user may deem necessary.

The Board wants to remind everyone that the marina is for the sole use of IBE residents as per the IBE Marina Policy. Marina slips may only be licensed or sub-let to IBE residents who either have a boat or will have a boat during the licensed year. Boat ownership is defined as the person or persons whose name the boat is registered under with the D.O.T. Ownership can therefore be traced and verified by the boat's registration number. Boat owners who are not residents of Indian Beach Estates cannot use the Marina slips.

With 142 residences only 62 marina slips it is clear that accommodating all IBE boat owners with mooring facilities is difficult. The Marina Policy is designed to accommodate the needs of the IBE residents first and accordingly, residents who do not adhere to the above policy may permanently lose their marina privileges.
