- No motorized vehicle or trailer of any kind shall be parked or left unattended at any time on any roadway.
- No motorized vehicle shall be operated on the property in such a way as to create excessive noise, or in any other way to cause a nuisance to other residents..
- Speed limits within Indian Beach Estates are 20 km..
- No all-terrain vehicle, snowmobile or any other off-road vehicle shall use IBE for recreational off roading..
- No dogs, cats or other pets are allowed to stray within the property and shall be kept in control at all times by their owners. Please respects the property of other IBE residents.Owners are expected to clean up after their pets. For animals causing a nuisance, contact the local animal control officer @ 347- 9793 Note; No livestock such as poultry, cattle, horses, shall be kept on the premises..
- All garbage placed in the Community dumpster must be in tightly closed bags or well secured boxes. If the dumpster is full call the Manager. Please do not leave the garbage outside the dumpster it will attract dogs and wildlife..
- Please keep off the areas marked "slope protection zone" between the beach and the marina and the beach and the osprey nest..
- No dogs, paddle boats, surfboards etc. are allowed on the swimming beach or within the marked swimming area..
- All motorized vehicles must post proper parking identification when parked at the marina or they will be subject to towing. For the complete set of the Marina Rules. Please refer to the IBE --Marina Use Rules on the IBE web site www.indianbeachestates.com. Note: the boat slip sharing program also available.
- All lots and buildings shall be kept properly maintained and neat in appearance. No building or other improvement shall be left uncompleted. Once work has commenced it must be completed within 9 months..
- No motor home, mobile home, recreational vehicle or any other temporary shelter shall be parked at any time on any lot, and used as a residence except as specially authorized by the resident Manager..
- No fireworks are permitted on IBE property at any time..
- Fire bans must be strictly adhered to..
- The Reserve Lands to the south of Indian Beach Estates are strictly off limit.
- All IBE residences must be single family dwellings. All buildings must conform to the standards of construction as set out by the Provincial or Municipal building by-laws and comply with restrictions set out in the Head Lease and Sub Lease. All buildings and major renovations must be approved by the board. Please allow adequate time for approval, due to the boards meeting schedule..
- Please respect others when playing stereos and having outdoor parties. Keep noise levels down after 11:00 pm.
IBE Marina Policy 2004
- Marina slips may only be licensed by or sub-let to IBE residents who either have a boat or will have a boat during the licensed year.Anyone subleting thier spot to an outside resident will loose there marina slip.
- IBE residents who wish to license a marina slip shall contact the Manager to have their name placed on the waiting list. Allocation of these slips will be based on the order in which they were placed.
- An IBE resident may license an additional marina slip so long as there is no resident on the waiting list, and will have to relinquish the additional slip once there is a waiting list.
- Slip holders are entitled to occupy the same slip they occupied the previous year.
- Except as allowed below, the marina slips are not transferable:
(a) a slip holder may sub-let his slip on a temporary basis to another IBE resident on terms acceptable to him with consent of the Board;
(b) slip holders may agree to exchange their slips upon notice to the Manager. A slip holder who has notified the Manager that he wishes to change his slip to a slip that is turned back fore re-allocation, shall have priority over the residents on the waiting list;
(c) a slip holder who sells his residence at IBE must turn his slip back to IBE for re allocation based on the waiting list.
(d) if there are no residents on the waiting list, then the selling resident may transfer the slip to the buyer of his residence or turn the slip back to the Manager for no payment if the buyer does not wish to acquire the slip. - Invoices for slips will be sent out each year to current slip holders with the Annual General Meeting information package. The slip holder has the right to elect to continue to license his slip by payment in full of the marina license fee for the current year. Payment in full of the marina license fee must be received by I.B.E.M.C by midnight, May 15 of each year (valid until May 15 of the following year), failing which the slip will be re-allocated to a resident next on the waiting list.
- Marina slips for small craft on the north side of the most northerly dock will be unassigned and for day use only.
- No boats with motors over 20hp are to be tied to any portion of the marina docks that are not a designated marina slip. No structure is to be attached to the marina docks or erected close to the marina or its docks without the consent of the Board. No boats with motors over 20hp are to be pulled up onto the grassy marina shore.

WATER USE BYLAWS
3.4 All persons shall keep the service pipes, stop cocks, fixtures, and fittings on their own premises (property) in good order and repair, and protect them from frost at their own risk and expense. When a premises is vacated, we suggest that your intake water valve be turned off.
3.5 Nothing contained in this Bylaw shall be construed to impose any liability on the IBE to give a continuous supply of water to any person or premises (property) and the IBE hereby reserves the right at any time to Turn Off the water to any premises (property) without giving notice to any person from whose premises (property) the water may be turned off.
3.6 No work of any kind connected with the Water System; either for the laying of new or repair of old service pipes shall be done within the Service Area by any person other than the Manager or a person authorized by the Manager.
4.5 No unauthorized person shall in any way interfere or tamper with any pipe, fixture, fitting or appliance of or connected with the Water System whether on his own premises (property) or elsewhere.
4.6 No person shall connect, cause to be connected, or allow to remain connected any piping, fixture, fitting, container, appliance or Cross-connection that could cause or allow drinking water quality, the service, or a private service to become contaminated, degraded or polluted in any way and under any condition, including but not limited to backflow caused by back pressure or back siphon age as a result of the disruption of the water supply from the Water System, unless an approved backflow prevention assembly has been installed and tested in accordance with this section.
(1) Where the Manager determines that there exists a connection or Cross-connection prohibited by this Bylaw, he may give written notice to the Owner to correct the connection or Cross-connection at the expense of the Owner within the time specified in the notice.
5.2 Each Owner shall be responsible for the repair and maintenance of all pipes and fixtures between the curb stop and his premises (property).
5.3 Every plumbing system shall conform to the appropriate government regulations and these regulations shall govern the administration and minimum requirements for the installation of water services to all premises (property) located within the Service Area.
5.6 The Board may, with notice, disconnect the water service to any premise (property) for any of the following reasons, and the IBE shall not be liable for damages by reason of discontinuing water service for such reasons:
(1) Unnecessary or wasteful use of water, or violation of regulations concerning watering or sprinkling;
(2) Failure to repair or replace defective pipes, fittings, valves, tanks or appliances which are leaking or are otherwise not in a good state of repair and which are or may become a cause of waste of water;
5.7 The Manager may, whenever in his discretion the public interest so requires, suspend or limit the consumption of water from the Water System, regulate the hours of use, or further prescribe the manner in which such water may be used.
When is a Building Permit Required?
B.C. Building Regulations require you to obtain a Building Permit if you are planning to: construct a new single family dwelling; construct an accessory building having a foot print area exceeding 100 square feet. make structural changes or repairs to a dwelling; adding an addition to an existing building Retaining wall/guard over 4ft. in height improve unfinished areas of a dwelling; demolish all or a portion of a structure or dwelling IE Balcony (decks) construction and replacement move a building either within a lot or onto another lot (with a special permit needed for moving on roadways) install a wood or oil burning appliance, a fireplace insert, or a hearth stove.
What is the purpose of the Building Permit and Inspections Procedure application? A Building Permit and subsequent inspections enable the RDEK to: ensure all building and construction comply with safety, structural, health and zoning regulations of the Province of B.C., and the R.E.D.K. inspect buildings at each stage of construction to ensure they are being built in accordance with the approved drawings and specifications (D & S); ensure that a newly constructed building has been constructed to a point where it is substantially completed and in compliance with applicable codes, regulations and bylaws, before an occupancy permit is issued.
The Site Plan drawing should include: location of the proposed building, any existing building(s) on the property with dimensions and setback distances to property lines; existing and finished ground elevations; the location of domestic water system and sanitary sewer system (including septic tank disposal field where applicable); lot grading and drainage, landscaping and driveway. In addition, the applicant must stake out the proposed building(s) and driveway location on the lot.
VIOLATION
2.02 Every person who violates any provision of this Bylaw, or who causes or suffers or permits any act or thing to be done in contravention of, or in violation of, any provision of this Bylaw, or who neglects to do or refrains from doing anything required to be done under provisions of this Bylaw, shall be guilty of an offence of this Bylaw.
PENALTY
2.03 Every person guilty of an offence of this Bylaw shall be liable on summary conviction to a penalty not exceeding two thousand dollars ($2,000.00) for each offence and costs of prosecution.

Size and Dimensions of Buildings and Structures
No person shall site a principal building in the R-1 zone which exceeds a height of 4.9 m (16 ft). Parcel coverage in the R-1 zone shall not exceed 30%.
The height restriction of 16ft in IBE is the only restriction that differs from the RDEK all other RDEK bylaws are applied to IBE as well
Hieght means the verticle distance from the finished gradeis of the build or structure to the mid point between the eves and the ridge of the primary roof.
