IBE MARINA SLIP POLICY

Fundamentally, the marina including the boat launch and surrounding area is for the exclusive and sole use of current residents of Indian Beach Estates (“IBE”). The demand for boat slips far exceeds the number of boat slips that are available. Current IBE residents that are allocated a boat slip, agree to abide by and follow the terms and conditions of this marina policy (the “marina policy”) and further agree that a breach of any one or more of the following terms of this marina policy will result in prompt forfeiture of the boat slip and re-allocation in accordance with section 5 of this marina policy.

  1. Marina slips may only be assigned to current IBE residents who either have a boat or will have a boat during the licensed year. A “current IBE resident” or “IBE resident” is the individual or individuals listed as the holder of the sub-lease attaching to any property within IBE or their immediate family. The “licensed year” shall be for the period from and commencing on April 1 and ending on March 31 of the following year. For greater certainty, any marina slip that is allocated to a current IBE resident (a “marina slip holder”), such IBE resident shall have a period of 12 months to acquire a boat and properly register such boat in accordance with section 2 of this marina policy which registration shall include payment of the slip fee. Failure to so register and pay the slip fee within the time period provided shall result in forfeiture of the boat slip and re-allocation of such slip in accordance with section 5 of this marina policy.
  2. Assignment of a marina slip is conditional on the IBE resident completing and returning, in accordance with the instructions,
    1. the annual boat registration form,
    2. payment of the annual marina slip fee (the “slip fee”), as such slip fee may be adjusted form time to time, and
    3. compliance with the terms and conditions of this marina policy. The annual boat registration form shall be completed by the IBE resident and must properly identify the IBE resident’s boat that will be occupying the marina slip. Any changes to the boat shall be communicated to marina@indianbeachestates.com. For greater certainty, unless otherwise provided for in this marina policy, marina slips are for the sole use of IBE residents and any contravention thereof will result in immediate forfeiture of the marina slip and reassignment of such slip in accordance with section 5 of this marina policy.
  3. Any IBE resident that has entered into a long term rental arrangement in compliance with the IBE Rental Policy shall not be entitled to receive assignment of a marina slip.
  4. IBE residents wishing to receive assignment of a marina slip, shall contact marina@indianbeachestates.com to receive assignment of their slip or, to have their name added to the waiting list (the “waiting list”). On average, one or two marina slips are returned to IBE on an annual basis.
  5. Subject to completion and submission of the annual boat registration form, payment of the annual slip fee, and compliance with the terms and conditions of this marina policy, a marina slip holder is entitled to occupy the same marina slip that they occupied the previous year. Further, any IBE resident that is a current marina slip holder may have their name added to the relocation list at any time and from time to time. Any marina slip that is returned to IBE and is available for reallocation shall:
    1. be offered for assignment to the IBE resident that occupied the marina slip the previous year provided such individual remains a current IBE resident;
    2. be offered for assignment to the IBE residents listed on the relocation list in descending order (a “relocation offer”); and
    3. to the IBE residents on the waiting list in descending order (an “assignment offer”). For greater certainty: (i) an IBE resident on the relocation list may accept or decline a relocation offer (such decision to be made within a reasonable time of being presented with the offer) and, if declined, may remain on the relocation list; and (ii) an IBE resident on the waiting list that is provided with an assignment offer shall have a period of 12 months from the date on which the assignment offer is made to accept the assignment offer by submitting the annual boat registration form and making payment of the slip fee, whereafter, such IBE resident shall be removed from the waiting list.
  6. Except as allowed hereby, marina slips are not transferable. A marina slip holder may sub-let their marina slip on a temporary basis to another IBE resident on terms acceptable to the marina slip holder and with the consent of the Board (such consent being necessary to ensure the appropriate boat registration details are obtained). A marina slip holder subletting their marina slip or otherwise allowing their marina slip to be occupied for any period of time by anyone outside of IBE or anyone other than a current IBE resident, will immediately forfeit their marina slip and such marina slip shall be re-allocated in accordance with section 5 of this marina policy.
  7. A marina slip holder who sells their residence at IBE must immediately turn the marina slip back to IBE for re-allocation. The only exception to the foregoing is if the sale of the IBE residence is to the current IBE residents spouse, children or grand children or if the IBE resident is re-locating within IBE. For greater certainty, an IBE resident that is on the relocation list or waiting list, as applicable, and sells their residence at IBE, will be removed from the relocation list or waiting list; their spot on the relocation list or waiting list is not transferrable (other than as set forth in this section to which marina slips are transferrable).
  8. Invoices for the slip fee will be sent out each year to marina slip holders. The marina slip holder has the right to elect to continue to occupy the marina slip by:
    1. completing and submitting the annual boat registration form;
    2. making payment in full of the slip fee; and
    3. continued compliance with the terms and conditions of this marina policy. The completed annual boat registration form and payment in full of the slip fee must be received by IBEMC on or before the applicable due date failing which the marina slip will be re-allocated in accordance with section 5 of this marina policy.
  9. No boats, personal watercrafts, kayaks, paddle boards, wind surfers, etc. are to be tied to any portion of the marina docks that are not designated marina slips. No structure is to be attached to the marina docks or erected close to the marina or its docks without the prior and express written consent of the Board.
  10. No boats, personal watercrafts, kayaks, paddle boards, wind surfers, etc. are to be pulled up and left overnight on the grassy marina shore.
  11. By making payment of the slip fee the user acknowledges and agrees that IBEMC is not responsible in any way for anything that happens to your boat, motor or contents, be it collision, sinking, theft, vandalism, rodents, fire, or any partial or total damage or loss however caused, and that use of the IBE marina is wholly at the user’s own personal risk and as such will maintain adequate insurance as the user may deem necessary.
  12. By making payment of the Marina Slip Fee the user acknowledges and agrees that IBEMC is not responsible in any way for anything that happens to your boat, motor or contents, be it collision, sinking, theft, vandalism, rodents, fire, or any partial or total damage or loss however caused, and that use of the IBE marina is wholly at the user’s own personal and property risk and as such will maintain adequate insurance as the user may deem necessary.

IBE Marina Slips

The Board wants to remind everyone that the marina is for the sole use of IBE residents as per this IBE marina policy. Marina slips may only be occupied by current IBE residents who either have a boat or, if provided with an assignment offer, will have a boat within 12 months following such assignment offer. Boat ownership is defined as the person or persons whose name the boat is registered under with the D.O.T. Boat owners who are not IBE residents cannot use the marina (which shall include the boat launch, parking lot and nearby grounds) or any marina slip at any time.

With 142 residences and only 62 marina slips, accommodating all IBE boat owners with mooring facilities is challenging. This marina policy is designed to accommodate the needs of IBE residents first and accordingly, IBE residents who do not adhere to the above policy may permanently lose their marina privileges.

Please be patient, it is not uncommon to have to wait several years for a marina slip; the demand far out paces the number of marina slips available.
